Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Cafiyn Pulse (“the Service”) operated by Cafiyn Technologies Private Limited (“Cafiyn”, “we”). By creating an account or using the Service you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old and legally able to enter into a binding contract. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
2. Account and security
You are responsible for maintaining the security of your account, including any activity that occurs under it. We authenticate access by email verification code; you agree to keep the email address associated with your account current and secure. Notify us immediately of any suspected unauthorised access.
3. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to derive the source code of the Service.
- Circumvent rate limits, authentication, or access controls.
- Automate, scrape, or crawl the Service in a manner that impairs performance for others.
- Upload malicious content, use the Service to distribute malware, or attempt to compromise other users' accounts.
- Use the Service to violate any applicable law, regulation, or third-party right.
- Resell, sublicense, or commercially exploit the Service without our prior written consent.
4. Your content
You retain ownership of any content you submit (grader answers, checklist state, cost projections). You grant Cafiyn a non-exclusive, worldwide, royalty-free licence to host, store, and process that content solely to operate the Service and provide it to you. This licence terminates when you delete your account, subject to the retention periods described in our Privacy Policy.
Shareable artifacts you generate (grade card, cost projection card, launch badge) are provided under a Creative Commons Attribution (CC-BY 4.0) licence for personal and marketing use.
5. Fees
The Service is currently provided free of charge. We reserve the right to introduce paid tiers in the future, in which case the free tier will remain available or you will be notified with at least 30 days' notice before any change to your account.
6. Third-party services
The Service links to third-party services (e.g., Cafiyn FlyWheel, model provider websites). We are not responsible for the content, security, or availability of those services. Your use of them is governed by their own terms.
7. Intellectual property
The Service, including software, brand, and content authored by us (grader questions, checklist items, taxonomy), is owned by Cafiyn and protected by copyright and trademark law. Nothing in these Terms transfers any of that intellectual property to you, except as expressly stated for shareable artifacts under section 4.
8. Disclaimer of warranties
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. The Stack Grader, Cost Comparator, and Launch Checklist are informational tools and do not constitute security, legal, financial, or engineering advice. You are responsible for verifying any recommendations against your own circumstances.
9. Limitation of liability
To the maximum extent permitted by law, Cafiyn's aggregate liability arising out of or relating to your use of the Service shall not exceed one hundred United States dollars (USD 100). In no event shall Cafiyn be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data, even if advised of the possibility.
10. Indemnity
You agree to indemnify and hold harmless Cafiyn from any claim, damage, or expense arising out of your breach of these Terms or misuse of the Service.
11. Termination
You may terminate your account at any time from your profile page. We may suspend or terminate your account without notice if we reasonably believe you are in breach of these Terms. On termination, sections 4 (content licence for retention window), 7-10, and 12 survive.
12. Governing law and dispute resolution
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Disputes shall be resolved by binding arbitration in Bangalore, India, under the Arbitration and Conciliation Act 1996. This does not affect any non-waivable statutory rights you have as a consumer under your local law.
13. Changes
We may update these Terms from time to time. Material changes will be notified to registered users by email at least 15 days before they take effect. Continued use after the effective date constitutes acceptance.
